1. Acceptance of these terms

These Terms of Use ("Terms") govern your use of this website, operated by Suncity Residents Welfare Association ("the Association", "we", "us"). By browsing the website, creating a resident account, submitting any content or using any feature, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.

2. About this website

The website is run by the Association's governing body, with the help of volunteers and an appointed web service provider, to share community information and to give residents a convenient way to interact with the Association. It is provided for the benefit of the residents of Suncity.

The website is not a government website and does not replace the Association's bye-laws, the resolutions of its governing body, or any statutory notice. Where this website and an official signed or minuted document differ, the official document prevails.

3. Resident accounts

  • Resident features (such as raising issues, commenting and viewing resident-only material) are available only to people who live in Suncity as owners or tenants, or who are otherwise approved by the Association.
  • New registrations are reviewed. The Association may verify your name, flat details and contact details before activating your account, and may decline or withdraw an account where it cannot do so.
  • You must give accurate and current information and keep it updated.
  • You are responsible for keeping your password confidential and for all activity under your account. Do not share your login with anyone, including family members who have not registered. Tell us immediately at the contact details below if you suspect your account has been used without your permission.
  • An account is personal to you. It may not be sold, transferred or used on behalf of a business.

4. Resident-only and confidential information

Parts of the website, including yearly audited financial statements and resident issues and discussions, are shown only to logged-in, verified residents. This material may include financial figures, names, flat numbers, contact details and complaints concerning identifiable people.

If you are given access to resident-only material you agree that you will:

  • use it only for your own legitimate interest as a member of the community;
  • not copy, forward, publish, post on social media or messaging groups, or give it to anyone outside the community without the written permission of the Association, except where the law requires or allows you to do so;
  • not collect residents' names, phone numbers, email addresses or flat details to build lists, send unsolicited messages, canvass or market to residents; and
  • not use automated tools, scripts or bulk downloading to collect material from the website.
Please note: deliberate misuse of confidential material may lead to suspension of your account and, where appropriate, action under the Association's bye-laws or applicable law.

5. Acceptable use

You agree not to use the website to:

  • break any law, or the Association's bye-laws and rules;
  • post anything that is abusive, threatening, harassing, defamatory, obscene, discriminatory on grounds such as religion, caste, gender or community, or that promotes hatred or violence;
  • make allegations about named individuals that you cannot support, or reveal another person's private information (for example, phone number, address, photographs, health, family or financial details) without their consent;
  • impersonate another person, a member of the governing body, or any organisation, or give false information about yourself;
  • post political campaigning, religious propaganda, chain messages, spam, or commercial promotion outside the areas meant for it;
  • upload viruses or harmful code, probe, scan or test the security of the website, try to access accounts, admin areas or files you are not entitled to, or interfere with the way the website works; or
  • overload the website, or copy or scrape it in an automated way.

6. Content you submit

"Content" means anything you submit through the website, including issues, comments, classified listing details, contact-form messages and any other material.

  • You are responsible for your content and confirm that you have the right to post it and that it is accurate to the best of your knowledge.
  • You give the Association a non-exclusive, royalty-free permission to store, display and use your content on the website and for the Association's administration, for as long as it remains on the website.
  • Opinions expressed by residents are theirs alone. They are not the views of the Association or its governing body.
  • The Association may review, edit for clarity or privacy, hide, move or remove any content, and may decline to publish it, without prior notice, if it appears to breach these Terms, the law, or the community's interests. Some items go through an approval step before they appear.
  • Content that is shown to "residents only" is visible to other verified residents and to the Association's administrators. Think carefully before posting anything personal.
  • Complaints and suggestions sent through the contact form are read by the Association's office-bearers and administrators and are handled according to the Association's procedures. We cannot promise a particular outcome or timeline.

7. Classifieds and dealings with advertisers or neighbours

The classifieds section is a notice board where residents and local providers can advertise items, services or requirements to the community. Listings are placed and published through the Association, may be limited to a period of time, and may be subject to a fee set by the Association. A listing shows the title, description, location and the contact details given for it, and is visible to the public.

The Association only provides the notice board. It is not a buyer, seller, broker, agent or guarantor, and does not check the quality, safety, legality, price or genuineness of any listing, person or transaction.

  • Any dealing is entirely between the people concerned. Use your own judgement, meet in safe places and do not share bank, card, UPI or OTP details with anyone.
  • If you ask us to publish a listing, you confirm that the details and contact information are correct and that the people named have agreed to be contacted.
  • Listings for illegal, unsafe, counterfeit or prohibited goods or services, and anything contrary to the Association's rules, are not allowed.
  • The Association may decline, edit or remove any listing at any time. Fees, where charged, are as communicated to you when the listing is arranged.
  • The Association is not responsible for any loss arising from a listing or a dealing.

8. Advertisements and sponsors

The website carries advertisements and sponsor messages. They help meet the cost of running the website. The presence of an advertisement is not an endorsement or recommendation by the Association, and the Association is not responsible for the products, services, offers or claims of advertisers. Please make your own enquiries before dealing with any advertiser.

When an advertisement is shown or clicked, the website records the event, together with your IP address and browser details, to count views and clicks and to detect misuse. See the Privacy Policy for details.

9. Notices, circulars and documents

News, circulars, forms, gallery items and financial statements are published to keep residents informed. We try to keep them accurate and current, but they may be corrected, replaced or withdrawn. Financial statements are published in the form approved or audited for the year shown; they are for information and are not tax, legal or investment advice. If you believe an entry is wrong, please tell us through the contact details below.

10. Personal data and privacy

We collect and handle personal data as described in our Privacy Policy. Residents' personal data is used only for running the Association and its website, is shown only to those who need to see it, and is protected using reasonable security measures. You, in turn, agree to respect the privacy of other residents, as set out in sections 4 and 5.

If you notice that personal or confidential information has been exposed by mistake, or that your account may have been misused, please inform us immediately so that we can act quickly.

11. Ownership and permitted use of material

The website's design, text, logos, graphics, software and compilation of information belong to the Association or its licensors, and are protected by law. Photographs and documents may belong to the people who created or supplied them. You may view the public pages and, where a download is offered, save a copy for your own personal, non-commercial use. You may not otherwise copy, republish, sell or commercially use the material, or remove any notice of ownership, without our written permission.

12. Third-party links

The website may link to other websites, or load tools from other services (such as fonts or icons). We do not control them and are not responsible for their content, availability or privacy practices. Using them is at your own risk and subject to their own terms.

13. Availability and changes to the website

We aim to keep the website available, but it may be unavailable from time to time because of maintenance, updates, faults or events beyond our control. We may change, suspend or withdraw any feature, page or content, or place the website in maintenance mode, at any time without notice. We do not guarantee that the website will be uninterrupted or free of errors.

14. Disclaimers and limits of liability

The website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law:

  • the Association, its governing body members, volunteers and service providers do not give any warranty about the accuracy, completeness or suitability of the content, and do not accept responsibility for opinions posted by residents or for dealings between residents or with advertisers;
  • we are not liable for any indirect or consequential loss, or for loss of data, profit or opportunity, arising from your use of, or inability to use, the website; and
  • nothing in these Terms limits any liability that cannot lawfully be limited, or any right you have under applicable law.

While we take reasonable care to protect the website and the data on it, no system is completely secure, and we cannot guarantee that it will never be affected by a technical fault or a security incident.

15. Suspension and removal

If you break these Terms, misuse resident information, or put the community or the website at risk, the Association may, without prior notice, remove your content, restrict features, suspend or close your account, and report the matter to the relevant authorities. You may ask us to close your account at any time. Sections that by their nature should continue (for example, confidentiality, ownership and liability) will remain in force afterwards.

16. Governing law and disputes

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, as applicable. We would like any concern to be settled amicably and promptly through the Association's governing body first. Subject to that, the courts at Gurugram, Haryana will have jurisdiction over any dispute arising from these Terms or your use of the website.

17. Changes to these terms

We may update these Terms from time to time, for example when we add a feature or when the law changes. The "Last updated" date at the top of this page will show when the latest version took effect. If you keep using the website after a change, you accept the updated Terms. For significant changes, we may also post a notice on the website.
